Commercial Court Strengthening Activity

Serbia 2004 - 2007

DPK worked on a 3-year, USAID-funded commercial court project as the principal subcontractor to Booz Allen Hamilton, to support the development of a more dynamic and competitive private sector in Serbia by improving the efficiency and effectiveness of institutions and processes that are essential to the increased growth of commerce and commercial enterprises. Project activities focused on providing technical assistance in court administration, case management, enforcement of judgments, technical training for judges and court staff, and public education reform. The project improved the internal workings of the commercial court system to expedite cases to a fair resolution.

DPK provided technical assistance to promote legal and regulatory reforms that strengthen the ability of the commercial courts to adjudicate commercial and economic cases quickly, efficiently, and predictably.

The project implemented a multi-year strategic vision for improving the overall organizational performance of the commercial courts to align operations with EU standards, international best practices, and the needs of a modern, diversified market economy.

DPK assisted in strengthening the administrative and management capacities of the Ministry of Justice, the commercial courts, and other key implementation partners in core functional areas including: strategic planning; resource planning; financial planning and budget development; fiscal and resource management; business process reengineering; data collection and management; court process automation; information technologies management; human resource development; and public and media relations.

The project built the capacity of key supporting institutions necessary to the efficient and transparent adjudication of commercial and economic cases by developing: lawyers' and judges' standards of professional ethics and discipline; mechanisms for service process; qualifications for expert witnesses; mechanisms for giving testimony by GOS personnel qualification and operation of bankruptcy trustees; techniques for valuation of assets; certification of compliance; enforcement of judgments; seizer and sale of assets; and alternative dispute resolution.

The project also promoted conditions for sustainable and constructive interaction among the GOS, the private sector, and civil society - all essential to a well-functioning, modern legal system in the wider European tradition.
